These Terms of Service ("Terms") govern your access to and use of Claims10x (the "Service"), including the website, maps, address lookups, and paid reports. By using the Service or purchasing a report, you agree to these Terms. If you do not agree, do not use the Service.
Claims10x is a weather-data lookup tool. It aggregates public-domain data from the U.S. National Weather Service, NOAA Storm Prediction Center, NOAA MRMS radar (MESH), and the Iowa Environmental Mesonet, and presents model estimates derived from that data.
The Service is not an insurance adjustment, not an engineering opinion, not a certified loss determination, and not a professional damage assessment. Claims10x does not inspect any property, does not measure hail at any address, and is not a licensed public adjuster, contractor, or engineer. Nothing in a report is an opinion that hail did or did not damage any specific property.
Radar (MESH) estimates the maximum hail size aloft over an area roughly one kilometer across; the actual size at a given address is typically smaller and uncertain. Report history covers 2015 to present and is incomplete — the absence of a report does not mean hail did not occur.
You agree not to submit Claims10x output as a hail determination, damage assessment, or expert opinion in any insurance claim, coverage dispute, or legal proceeding, and not to rely on it to grant, deny, or adjust any claim. Claims10x output is decision-support and triage information only.
The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Claims10x does not warrant that the data or estimates are accurate, complete, current, or suitable for any purpose.
To the maximum extent permitted by law, Claims10x and its operator will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits, lost claims, denied coverage, or business losses, arising from your use of or reliance on the Service. Claims10x's total aggregate liability for any claim arising out of or relating to the Service or a report will not exceed the amount you paid for that report (or, if you paid nothing, USD $29).
Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered under the rules of a recognized arbitration provider, and not in court. You and Claims10x waive any right to a jury trial. You may bring claims only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may opt out of this arbitration agreement by emailing the operator within 30 days of first purchase.
Reports are sold for a one-time fee shown at checkout. Because reports are delivered as digital information immediately, all sales are final except where required by law or where the Service fails to deliver a purchased report, in which case your sole remedy is a refund of the fee paid.
Underlying weather data is U.S. Government public-domain work (17 U.S.C. §105) plus Iowa Environmental Mesonet Local Storm Reports (attributed per IEM's request). Claims10x is an independent product and is not affiliated with, endorsed by, or certified by NOAA, the National Weather Service, or any government agency.
